Chapter 7

Also known as “straight bankruptcy” or “liquidation”, Chapter 7 is the most common form of bankruptcy. Filing a Chapter 7 bankruptcy immediately stops creditor calls and collection attempts. It can also put a hold on foreclosure and repossession, giving you time to make other arrangements for you and your family. You can wipe out most, if not all, of your debts through the Chapter 7 discharge. Most Chapter 7 cases are finished in just a few months, allowing you to start rebuilding your credit as quickly as possible.

Chapter 13

Chapter 13 bankruptcy is a great option if you are behind on your house or car payments and want time to “catch up,” so you can keep the property. Chapter 13 may also be the best option if you do not qualify for a Chapter 7 case, or if you have a large amount of unprotected equity in your home that you may lose in a Chapter 7 case. Chapter 13 involves repayment of debt (some or all) through a court-approved payment plan for 3 to 5 years. A Chapter 13 repayment plan can lower your monthly debt payments and give you some much needed breathing room. Chapter 13 allows you to discharge (wipe out) debt, while you keep the property you want to keep.

Chapter 11

Individuals may file a Chapter 11 case when they want the benefits of a Chapter 13 repayment plan, but their debt is too high for a Chapter 13 case. There are also other benefits to individuals filing a Chapter 11 case over a Chapter 13 case:

  • Prepetition mortgage arrears too high to pay in five years
  • Pay the value of a car (if less than the amount you owe) that was recently financed
  • You recently received a Chapter 7 or Chapter 13 discharge
  • More time to pay non-dischargeable debts, like payroll taxes
